Privacy Policy (draft as of 29 October 2024)
Ancestors was created by The Smartphone Orchestra, which exists within the foundation Stichting WildVreemd. This privacy policy applies directly to Ancestors. We, as Stichting WildVreemd, respect the privacy of all participants of Ancestors, and through this privacy policy, we aim to be transparent and clear regarding the processing and usage of participantsā personal data, as well as what rights you have as a participant. We understand the implications and concerns when collecting and using any personal data, and we take that responsibility seriously. All data is end-to-end encrypted.
Hereās what we collect from participants of Ancestors:
- Username: This is the unique username a participant decides upon, whether directly related to their own name or not, at the start of the experience as part of the registration/onboarding process.
- Personal Photo/āSelfieā: This is the image participants take of themselves at the start of the experience as part of the registration/onboarding process.
- Unique Phone IP Address: Your phoneās IP address (whether using your mobile providerās network or the WiFi network of the venue) is collected and connected to your Username and Selfie, at the start of the experience as part of the registration/onboarding process.
- Text Responses: Other text responses you submit from time to time throughout the experience.
Hereās how we use that data:
- Username: We use your unique username to connect you with the other data that we collect from you throughout the experience, to ensure it doesnāt get misattributed to another participant. We also save the username for the duration of the experience in case you need to log back in for whatever reason. There are a few moments throughout the experience in which your username is drawn from the database in order to provide you with personalized text.
- Personal Photo/āSelfieā: We use an open source image generating software to merge your Selfie with other participantsā selfies (the results of which are then merged to create new images) throughout the experience. The image generating software exists only on our computers and all images, including your original Selfie, are not accessible by any third-party. Your Selfie is also shown at various points during the experience as a āfamily treeā visual for all participants.
- Unique Phone IP Address: We use your unique phone IP address to connect you with the other data that we collect from you throughout the experience, to ensure it doesnāt get misattributed to another participant.
- Text Responses: Other text responses return from time to time throughout the experience as a reflection on our real (and/or imagined) life experiences and how they may influence future generations.
Hereās how we handle that data after the experience:
- We ask you during the experience if you will permit us to use your Selfie for overall improvements of the experience as well as for marketing purposes.
- If you grant us permission to use your Selfie, we will only ever use it for those purposes. We may also retain your username simply for the purposes of ensuring we are using the correct selfie with those that gave us permission.
- All other data is deleted from our servers immediately after the experience.
- If you do not grant us permission to use your Selfie, all data, including your Selfie and username, is deleted from our servers immediately after the experience.
Throughout every step, we comply with national and international authorities; however, if you are ever unsure or would like to submit a notice, you can do so via the Dutch Data Protection Authority (āAutoriteit Persoonsgegevensā): https://autoriteitpersoonsgegevens.nl.
One area in which we do not have any control is if individual participants take screenshots or phone recordings during the experience and choose to make those visible to the public, such as on social media or otherwise. In such instances, participants are free to do so without any permission from us.
Should you see yourself on our own social media channels or other marketing outreach methods, whether or not you previous gave us permission to use your selfie, and do not or no longer wish to be featured in such a manner, you can contact our team at info@smartphoneorchestra.com, and we will remove the image as soon as possible.
Sharing data with third parties
The few third-party providers we work with, for the purpose of handling your personal data for the sake of the experience, follow national and international guidelines for data protection and privacy. Such data shared with these third-party providers is anonymous and encrypted, and it will never be identifiable back to you.
Access to your data
We allow only appropriate and authorized individuals and third-party providers access to your data when it is critical for the sake of the experience. We will not process your data without prior authorization, nor will we sell your data to any third party.
Data hosting and transferring
We primarily host your data within the Netherlands, but it is possible that we might transfer some or all of it to countries within the EEA, to the UK or in exceptional circumstances outside of those areas. We comply with the relevant data protection laws when sending data overseas. We rely on data processing agreements containing EU standard contractual clauses and take additional measures to secure this data transfer, such as anonymization.
Technical security measures
All of our own devices which are used to collect and use your data are secured with antivirus software, firewalls and encryption. We regularly update operating systems and software to ensure vulnerabilities cannot be exploited.
Your rights
You always have the right to information, access, rectification, deletion and restriction of your data. You can exercise these rights by contacting us at the email address below, and we are obligated to respond to you within one month of receiving your communication. If you fear that your data is not be handled responsibly by us, you can file a complaint with the Dutch Data Protection Authority (āAutoriteit Persoonsgegevensā) as listed above.
Applicable Law
The conditions within this policy are governed by Dutch legislation. The court in Amsterdam has the sole jurisdiction if any dispute regarding these conditions may arise, save when a legal exception applies.
